Your use of the Platform and of our products and services (collectively, the "Services") is governed by these terms and conditions ("Terms of Use"), together with our Privacy Policy, Shipping Policy, and Refund, Return & Cancellation Policy, which are incorporated by reference. If you transact on the Platform, those policies apply to your transaction. Any terms proposed by you that add to or conflict with these Terms of Use are expressly rejected and shall have no effect. We may update these Terms of Use from time to time; the version posted here with the latest "Last updated" date applies to your use going forward, and it is your responsibility to review this page periodically.

For the purpose of these Terms of Use, "you," "your," or "user" means any natural or legal person who uses the Platform or purchases from us. You must be at least 18 years old to purchase from the Platform.

Accessing, browsing or otherwise using the Platform indicates your agreement to all the terms and conditions under these Terms of Use — including the arbitration agreement and class action waiver below, which affect your legal rights. Please read them carefully before proceeding.

You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of our Services and the Platform is solely and entirely at your own risk and discretion, for which we shall not be liable to you in any manner beyond what applicable law requires. You are required to independently assess and ensure that the Services meet your requirements.

You agree to pay us the charges associated with availing the Services. All prices are in US dollars. We may refuse or cancel any order, including for suspected fraud or pricing errors — if we cancel a paid order, we will refund you in full.

If you purchase a subscription, it automatically renews at the interval and price shown at checkout until you cancel. You can cancel at any time from your account page or by email, effective from your next billing cycle.

You agree not to use the Platform and/or Services for any purpose that is unlawful, illegal or forbidden by these Terms, or by any applicable federal, state, or local laws that might apply to you.

You agree and acknowledge that the website and the Services may contain links to other third-party websites. On accessing these links, you will be governed by the terms of use, privacy policy and such other policies of those third-party websites. These links are provided for your convenience only, and linking does not imply endorsement.

You understand that upon initiating a transaction for availing the Services, you are entering into a legally binding and enforceable contract with us for the Services.

Limitation Of Liability

To the fullest extent permitted by law, Follicode Genesis LLC and its members, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or products. Our total liability for any claim will not exceed the amount you paid us for the product giving rise to the claim. Some states do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

You shall indemnify and hold harmless Follicode Genesis LLC, its affiliates and their respective officers, members, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of your breach of these Terms of Use, the Privacy Policy and other policies, or your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

Force Majeure

Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event.

Disputes — Arbitration & Class Action Waiver

Before filing any claim, contact us at support@tryheyhoney.com — most issues get resolved quickly and informally, and we'll have 30 days to work it out with you.

If we can't resolve it informally, you and we agree that any dispute arising from these Terms or our products will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Either party may instead bring an individual claim in small claims court. Disputes will be resolved on an individual basis only — you and we each waive the right to a jury trial and to participate in a class action, class arbitration, or representative proceeding.

You may opt out of this arbitration agreement by emailing us with the subject "Arbitration Opt-Out" within 30 days of your first purchase. Opting out won't affect any other part of these Terms.

Governing Law & Jurisdiction

These Terms and any dispute or claim relating to them, or their enforceability, shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-law rules, and by the Federal Arbitration Act with respect to the arbitration section above.

Any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

Communications

All concerns or communications relating to these Terms must be communicated to us using the contact information provided on this website. If any provision of these Terms is found unenforceable, the rest remains in effect.
